Before diving into employment and credit laws, let's dispel a myth that's been perpetuated online. When you hear things like “a bad credit score can prevent you from getting a job,” it's actually not true. That's because employers don't pull your actual credit scores like a lender might, says Griffin.
Rather, potential employers are assessing an applicant's financial behaviors by reviewing a modified version of their credit report that includes credit accounts, payment history, debts, bankruptcies or liens, and certain work history.
So, under what circ*mstances can an employer legally ask for and obtain your account information? A potential employer may verify your job history by checking your bank statements for deposits from your former employer. They may also ask for your banking information or a voided check to set up direct deposit payments.
If an employer conducts a credit check and finds a number of red flags, such as high levels of debt, bankruptcy, or a history of late payments, they may reconsider their decision to offer you the job. Although it may seem unfair, it's legal in many states for employers to take this action.
Employers may never consider an applicant's arrest that didn't result in a conviction, an expunged record, a juvenile arrest or detention, or a non-felony marijuana conviction that is two or more years old.
In order to obtain and maintain a career in the financial industry, it is also important to have a clean credit report. Note that the following states limit an employer's right to check your credit report: California, Colorado, Connecticut, Hawaii, Illinois, Maryland, Nevada, Oregon, Vermont, and Washington.

Can you be denied a job because of bad credit in New York?
Because there is no evidence linking poor credit to job performance, the law prohibits the use of credit in employment decisions for almost all positions. You cannot ask job seekers or current employees about their credit history, which includes credit worthiness, credit capacity, and payment history.
Per New York state law, CRAs cannot report or keep in their files any conviction records, judgments, and paid tax liens more than seven years old, bankruptcies more than 14 years old, judgments that were paid within the last five years, or arrests that did not lead to a conviction (except for pending cases).

Can employers see your work history? Employers can, and usually will, verify that you've worked at the jobs you list on your resume. However, they won't typically find past jobs that you haven't listed on your resume unless you added them to your credit report or posted about them on social media.
